BirdPedy es una app gratuita para observar y coleccionar las aves de España, hecha por José Manuel Marín. No es una empresa. Contacto:BirdPedy is a free app for watching and collecting the birds of Spain, made by José Manuel Marín. It is not a company. Contact: birdpedy@gmail.com, en español o en inglés. Es también el punto de contacto para usuarios y autoridades a efectos del Reglamento de Servicios Digitales de la UE., in Spanish or English. It is also the point of contact for users and authorities under the EU Digital Services Act.

2. Gratis y sin compras2. Free, with no purchases

BirdPedy no tiene anuncios ni nada que se pague. Las plumas son una moneda de la app que se gana usándola; no tienen valor fuera de ella y no se pueden comprar, vender ni canjear por dinero.BirdPedy has no ads and nothing to pay for. Feathers are an in-app currency earned by using it; they have no value outside the app and cannot be bought, sold or exchanged for money.

3. Tu cuenta3. Your account

Para crear una cuenta hay que tener al menos 14 años. Eres responsable de lo que se haga con ella; si crees que alguien la está usando, escríbenos. PuedesYou must be at least 14 to create an account. You are responsible for what is done with it; if you think someone else is using it, write to us. You can eliminarla cuando quierasdelete it whenever you want.

4. Normas de la comunidad4. Community rules

• Registra solo avistamientos reales, en el lugar y la fecha en que los hiciste. El mapa lo usan otras personas para decidir adónde ir.Only record real sightings, at the place and date you made them. Other people use the map to decide where to go.
• Piensa en las aves antes que en el avistamiento: no publiques la ubicación de nidos, dormideros o aves sensibles a las molestias, y no las persigas ni las molestes para conseguir una foto.Put the birds before the sighting: do not publish the location of nests, roosts or birds sensitive to disturbance, and do not chase or disturb them to get a photo.
• No marques en el álbum aves que no has visto para desbloquear premios.Do not mark birds you have not seen in the album to unlock rewards.
• Trata bien a los demás: nada de insultos, acoso, odio, contenido sexual ni violento, ni publicidad no pedida.Treat others well: no insults, harassment, hate, sexual or violent content, or unsolicited advertising.
• No publiques fotos de otras personas sin su permiso ni contenido sobre el que no tengas derechos.Do not post photos of other people without their permission, or content you do not have the rights to.
• No reportes avistamientos de otros sin motivo.Do not report other people's sightings without reason.
• No uses la app ni sus datos de forma automatizada (robots, extracción masiva) ni intentes acceder a datos de otros usuarios.Do not use the app or its data in an automated way (bots, mass scraping) or try to access other users' data.

5. Moderación5. Moderation

Puedes reportar avistamientos, usuarios y actividades, y bloquear a otro usuario. Cuando lo reportan tres personas distintas, deja de mostrarse en el mapa; que el ave ya no esté en la zona no cuenta, porque no significa que el avistamiento fuera falso. Quien lo registró recibe un aviso en la app con el motivo, sin saber quién lo ha reportado. También puedes avisar de cualquier contenido ilícito o que incumpla estas normas escribiendo aYou can report sightings, users and activities, and block another user. When three different people report it, it is no longer shown on the map; the bird no longer being in the area does not count, because it does not mean the sighting was false. The person who recorded it gets a notice in the app with the reason, without knowing who reported it. You can also flag any illegal content, or content that breaks these rules, by writing to birdpedy@gmail.com.

Si se incumplen estas normas, podemos retirar el contenido y, en casos graves o repetidos, suspender o cerrar la cuenta. Te diremos qué se ha hecho y por qué, salvo que la ley lo impida. Si crees que es un error, incluido un avistamiento ocultado por reportes, escríbenos y lo revisamos.If these rules are broken, we may remove the content and, in serious or repeated cases, suspend or close the account. We will tell you what was done and why, unless the law prevents it. If you think it is a mistake, including a sighting hidden by reports, write to us and we will review it.

6. Lo que publicas6. What you publish

Lo que publicas sigue siendo tuyo. Nos das permiso, gratuito y no exclusivo, para mostrarlo dentro de BirdPedy mientras lo tengas publicado; cuando lo borras o eliminas la cuenta, deja de mostrarse. Eres responsable de lo que publicas.What you publish remains yours. You give us free, non-exclusive permission to show it within BirdPedy while it is published; when you delete it or your account, it stops being shown. You are responsible for what you publish.

7. Organizadores de actividades7. Activity organisers

Las cuentas de organizador pueden publicar proyectos y actividades, con los límites del plan gratuito. Las puede pedir cualquiera que organice actividades relacionadas con las aves, también un particular sin empresa. Se piden desde la app y las revisamos a mano, una a una; lo que se acepta al pedirlas está en las condiciones para organizadores. Cada organizador es responsable de lo que publica y de sus actividades: inscripciones, precios, seguridad y los datos que recoja en sus propios formularios. “Me interesa” no es una inscripción: solo guarda la actividad para ti y le dice al organizador cuántas personas la han marcado.Organiser accounts can publish projects and activities, within the limits of the free plan. Anyone who organises bird-related activities can request one, including an individual without a company. They are requested from the app and we review each one by hand; what is accepted when requesting one is set out in the terms for organisers. Each organiser is responsible for what they publish and for their activities: sign-ups, prices, safety and the data they collect in their own forms. “I'm interested” is not a sign-up: it only saves the activity for you and tells the organiser how many people marked it.

They are for guidance: a bird seen yesterday need not still be there today.

9. Responsabilidad9. Liability

BirdPedy se ofrece tal cual y gratis, por una sola persona. Puede tener errores o dejar de estar disponible un tiempo. No respondemos de lo que publiquen otros usuarios ni de las actividades de los organizadores. Sal al campo con prudencia: respeta los espacios protegidos, las propiedades privadas y la normativa de cada lugar. Nada de esto limita los derechos que te reconoce la ley como consumidor.BirdPedy is offered as is and free of charge, by a single person. It may have errors or be unavailable for a while. We are not responsible for what other users publish or for organisers' activities. Go out into the field carefully: respect protected areas, private property and local regulations. None of this limits your statutory rights as a consumer.

Estos términos se rigen por la ley española. Si surge un problema, escríbenos primero: casi todo se arregla así. Si no, puedes acudir a los juzgados de tu domicilio.These terms are governed by Spanish law. If a problem arises, write to us first: almost everything gets sorted that way. Otherwise, you may go to the courts of your place of residence.
